Sides unable to settle on Midyette trial date
Lawyers in the Alex Midyette child abuse case were unable to set a new trial date Friday morning during a hearing in Boulder County District Court.
Midyette's trial was to have started Monday in Jefferson County, but that date was thrown out by a judge two weeks ago when the defense asked for more time to review medical evidence and assess recently named witnesses for the prosecution.
In a Sept. 19 order, District Judge Carol Glowinsky said the trial should be held no later than January.
But Carolyn French, a spokeswoman for the district attorney's office, said Friday that more time is needed to find an available courtroom for the three to four-week trial. She said it's possible the trial, which was moved to Jefferson County in the summer because of pre-trial publicity, might have to be held in an entirely different location.
The sides will get together again Oct. 17 to schedule a new trial date.
Midyette, 29, is charged with causing the death of his 11-week-old son, Jason Midyette, in March 2006. His wife, Molly Midyette, was convicted in December of child abuse in the case and is serving 16 years in prison.

Yes he loves living the life of a single person. This is what money can buy. His son is dead and he can party for the rest of his life. He will meet his maker one day and have to answer.

Apparently Boulder has exported their smooth running justice system to Jefferson County. Another example of the evil of outsourcing.
